Family Law
Property Settlements
An analysis of all assets and liabilities of a relationship in both de facto and marital separations. We work towards mutual and amicable resolutions, where possible. We provide advice throughout the remainder of the Family Law Court process. This process may include; mediation, conciliation or arbitration, and if no agreement is reached, being listed for a court hearing for final judgment.
Children Matters
We provide advice on all aspects of family law matters involving children. Issues of child custody arrangements and parental responsibility can be stressful for all involved parties, including the children. We focus on the best interests of the child and provide advice relating to your own individual circumstances.
Consent Orders & Binding Financial Agreements
A consent order is the culmination of an agreement by all parties regarding their property interests, which is considered to be ‘just and equitable’ by the Family Courts. Once sealed by the Courts, the agreement becomes binding upon all parties. We provide advice through the entirety of the process.
In particular circumstances, a binding financial agreement may function as a viable alternative to a consent order, with every matter being considered individually. A strict process is required to be followed and we provide personalised advice along with document drafting services where necessary.
Divorce Matters
The divorce system in Australia functions on a no-fault basis. We provide advice on navigating the court systems and assist with lodging both single and joint applications for divorce.
Estate Law & Succession Planning
Administration of Estates
Dealing with the passing of a loved one can be difficult to cope with, further complicated when also dealing with the administration of their estate. We aim to relieve your stress by providing advice and undertaking work to ensure the estate is properly dealt with, in accordance with the wishes of the deceased. We liaise with various financial institutions to ensure their requirements are complied with and provide advice personalised to each individual situation.
Wills
A well drafted Will safeguards your wishes and allows your property and possessions to be given to your chosen beneficiaries after your death. We take the time to sit down with each client to understand what they want and how they would like their estate to be distributed.
Power of Attorney’s
Granting Power of Attorney allows you to appoint a trusted person to make decisions on your behalf. An Enduring Power of Attorney can be personalised to allow personal (including health) matters and/or financial matters to be dealt with either immediately, once you lose capacity or in specific circumstances. A General Power of Attorney allows you to appoint a person for a specific matter.
Advance Health Directives
Planning for the worst is never pleasant, but an Advance Health Directive will instruct your family or doctors appropriately so they can carry out your wishes in the event you are unable to make your own decisions. We’ll work with your GP to provide advice ensure your Advance Health Directive is compliant with the legal process and expresses your own personal wishes.
